1. General Provisions
These Terms and Conditions regulate the relationship between Nautic ZD d.o.o. (hereinafter: the Seller) and customers who purchase products through the online store shop.nautic-zd.hr.
By using this online store and placing an order, the Customer confirms that they have read, understood and accepted these Terms and Conditions.
The Seller reserves the right to amend these Terms and Conditions at any time. All changes become effective upon publication on the website.

3. Product Offer
The webshop shop.nautic-zd.hr offers nautical equipment, fenders, covers, maintenance equipment, safety equipment and other products from the Seller’s assortment.
The Seller makes reasonable efforts to ensure that all product information, descriptions, technical specifications, prices and photographs are accurate. However, minor differences may occur between the displayed product and the actual product, especially due to screen settings, product series or technical changes made by the manufacturer.
4. Prices
All prices in the webshop are expressed in euros (EUR) and include VAT, unless stated otherwise.
The price valid for the Customer is the price displayed at the moment of order confirmation. The Seller reserves the right to change prices without prior notice.
Delivery costs are not included in the product price unless expressly stated otherwise and are displayed during the checkout process before final order confirmation.
5. Ordering Process and Contract Formation
The purchase process consists of the following steps:
1. selecting products and quantities
2. adding products to the cart
3. entering billing and delivery details
4. selecting payment and delivery method
5. reviewing the order, delivery cost, VAT and total amount
6. accepting these Terms and Conditions
7. confirming the order
After completing the order process, the Customer receives an order confirmation by e-mail.
The purchase agreement is considered concluded when the Seller confirms the order.
6. Payment Methods
The Customer may pay using payment methods available in the webshop at the time of purchase, such as:
– credit and debit cards through the Monri WebPay system
– bank transfer / internet banking
– other electronic payment methods displayed during checkout
If card payments are enabled, the webshop may accept the following cards, depending on activated payment options: American Express®, Mastercard®, Maestro® and Visa.
The Seller will not request additional card information from the Customer outside the secure payment process. Card details must not be sent by e-mail, phone or chat.
7. Card Payment Security
Card payments are processed through the secure Monri WebPay Payment Gateway.
Data confidentiality is protected by TLS/SSL encryption. Online payment pages are secured by security protocols that enable secure data transfer and prevent unauthorized access during communication between the Customer, the webshop and the Monri WebPay Payment Gateway.
Monri WebPay Payment Gateway and financial institutions exchange data through protected communication channels.
Monri Payments is a PCI DSS Level 1 certified payment service provider compliant with Visa and Mastercard rules.
The Seller does not store credit or debit card numbers. Card data is not available to the Seller or to unauthorized persons.
Where applicable, the webshop uses the 3D Secure security protocol, which enables additional user authentication during online card payments through the card issuer’s bank system.
8. Payment Currency and Conversion
All payments are made in euros (EUR).
If the Customer uses a card linked to an account in another currency, the charged amount may be converted into the Customer’s local currency according to the exchange rate of the card scheme or the card issuer’s bank. Due to such conversion, the charged amount may slightly differ from the price displayed in EUR.
9. Delivery
Products are delivered through a contracted delivery service or another logistics partner.
Delivery time depends on product availability, delivery method and delivery destination. The usual delivery time within the Republic of Croatia is 1 to 5 business days, unless stated otherwise for a specific product.
Delivery costs are displayed to the Customer during the checkout process before final order confirmation.
In case of unforeseen circumstances, delivery delays, supplier delays, weather conditions, holidays or other circumstances beyond the Seller’s control, the delivery period may be extended.
Upon receipt of the shipment, the Customer should inspect the package. If the package is visibly damaged, the Customer is advised to refuse delivery or immediately report the damage to the delivery service and the Seller.
10. Product Unavailability
If an ordered product is not available, the Seller will inform the Customer as soon as possible. The Customer may accept a new delivery date, accept a replacement product or cancel the order for the unavailable product.
If payment has already been made and the Customer does not accept a new delivery date or replacement product, the Seller will refund the paid amount.
11. Complaints
The Customer has the right to submit a complaint in case of:
– damaged product
– incorrectly delivered product
– defective product
– product not matching the order or description
Complaints must be submitted in writing to: info@shop.nautic-zd.hr.
For faster processing, the Customer should provide:
– order number
– customer’s full name
– description of the issue
– photo of the product or damage, if applicable
The Seller will confirm receipt of the complaint without delay and respond within the legally prescribed deadline.
12. Refunds
If the Customer is entitled to a refund, the Seller will refund the amount using the same payment method used for the original payment, unless otherwise agreed.
For card payments, the refund is processed through the payment system and/or card scheme, in accordance with the rules of the payment service provider and the card issuer’s bank.
The Seller may withhold the refund until the returned goods are received or until the Customer provides proof that the goods have been sent back, whichever occurs first.
13. Right of Withdrawal
A Customer who is a consumer has the right to withdraw from the contract without giving any reason within 14 days from the day on which the Customer or a third party designated by the Customer, other than the carrier, takes possession of the goods.
To exercise the right of withdrawal, the Customer must inform the Seller by an unequivocal statement sent by post or e-mail.
In case of withdrawal, the Customer must return the goods without undue delay and no later than 14 days from the day on which they informed the Seller of the withdrawal.
The Customer bears the direct cost of returning the goods, unless otherwise agreed or unless the return is caused by an error of the Seller.
The Customer is responsible for any diminished value of the goods resulting from handling other than what was necessary to establish the nature, characteristics and functionality of the goods.
14. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in cases prescribed by applicable law, especially for goods made to the Customer’s specifications or clearly personalized for the Customer, as well as for other products for which the right is excluded by law.
15. Product Defects and Liability
The Seller is liable for material defects of products in accordance with the applicable laws of the Republic of Croatia.
The Customer should report visible defects without undue delay after receiving the product and hidden defects as soon as they are discovered.
16. Personal Data Protection
The Seller processes Customers’ personal data only for the purposes of order processing, product delivery, customer communication, fulfillment of legal obligations and, where consent is required, marketing purposes.
The Seller collects only basic data necessary to fulfill the order and legal obligations. All customer data is treated as confidential and is available only to persons who need it to perform their work.
The Customer may refuse participation in marketing activities and may withdraw consent for marketing data processing at any time.
Personal data processing is carried out in accordance with applicable personal data protection laws and the General Data Protection Regulation (GDPR).

17. Cookies and Tracking Technologies
The website may use cookies and similar technologies for proper website functionality, user experience improvement, analytics and marketing activities.
Cookies that are not necessary for the operation of the website are used only with the user’s consent.

18. Intellectual Property
All content published on shop.nautic-zd.hr, including texts, photographs, graphics, logos, product descriptions and other materials, is protected by intellectual property rights and may not be used, copied or distributed without prior written permission of the rights holder, except where permitted by law.
19. Accuracy of Information
The Seller makes reasonable efforts to ensure that all webshop information is accurate, complete and up to date. However, unintentional errors in product descriptions, photographs, prices, stock availability or other information may occur.
The Seller reserves the right to correct such errors without prior notice.
20. Dispute Resolution
In the event of a dispute between the Customer and the Seller, the parties will attempt to resolve the dispute amicably.
If this is not possible, the competent court according to the Seller’s registered seat shall have jurisdiction, unless otherwise prescribed by applicable law.

21. Final Provisions
These Terms and Conditions apply from the date of their publication on shop.nautic-zd.hr.
The Customer confirms that, before purchasing, they have read and accepted these Terms and Conditions in full.
